Parking Infringement Appeals

To appeal a parking infringement, it is necessary to submit a written or online application to the Town of Victoria Park before the due date stated on the infringement notice. We regret to inform you that we cannot accept appeals over the phone. The Mayor and Councillors are not able to respond to letters regarding infringements; therefore, any requests for an internal review must be directed to the Infringement Appeals Team.

It is crucial to note that if you were the driver at the time and believe that you have valid reasons, you can submit an appeal along with supporting evidence for internal review. However, verbal appeals are not acceptable, and the driver must submit the appeal at the time of the infringement. It is essential to check the eligibility criteria before submitting an appeal online or in person.

In case you were not the driver but the owner of the vehicle at the time of the infringement, you must nominate the driver or the person in charge of the vehicle within 28 days. Under the Local Government Act, vehicle owners are considered responsible for the offence unless they nominate another the driver within the stated timeframe. 

To understand the infringement process, it is vital to follow the outlined procedures. There are two flowcharts available below that illustrate the steps involved after receiving an infringement and after submitting an appeal.

How to appeal a parking infringement 

View the photos taken of your parking infringement

Before paying or appealing a parking infringement, you should view the photos taken of your parking infringement. You will need to provide the infringement number and vehicle registration number to view the photos. View infringement photos and details here.

Identify the grounds for your internal review

To appeal a parking infringement, you must identify the grounds for your internal review. 

Below are some common reasons that drivers have for requesting a review. Select the most appropriate scenario to see if we will consider your circumstances and what information you need to provide. 

Make sure you provide all the details as well as any supporting documents from third parties. You need to provide all the relevant information upfront to help us make a decision.

Complete appeal form

Due to a high volume of customer queries and appeals, it may take up to four (4) weeks for your appeal to be reviewed. Once you have submitted the online appeals form, the infringement will automatically be placed on hold until it's reviewed. A confirmation email will be dispatched to the email address you provided, serving as a record of the successful submission of your appeal.

Common appeal reasons

I WAS DEALING WITH A MEDICAL EMERGENCY

If a medical emergency occurred, we require an official letter from your hospital or doctor confirming that you were involved in an emergency at the time of the infringement, and how this prevented you from parking legally.

I DIDN’T DISPLAY A VALID PARKING PERMIT FOR PEOPLE WITH DISABILITIES

Are you the ACROD permit holder?

We will only consider withdrawing this fine if you were the driver and your permit had recently expired or was not correctly displayed. Please submit a copy of the permit used on the day or renewed permit if applicable.

Were you driving the ACROD permit holder?

We do not withdraw where a driver was transporting the permit holder; drivers are responsible for the correct use and display of a valid permit.

MY VEHICLE BROKE DOWN

We expect you to take action immediately if your vehicle breaks down. Please contact the Town immediately and advise of your breakdown and estimate when your vehicle can be moved again.

If your vehicle broke down you’ll need to supply a:

  • Letter from a roadside assistance provider (showing the vehicle registration, date, time, and location of where it was repaired, or
  • Mechanics invoice (detailing the work performed, date, and time), or
  • Receipt /invoice if the vehicle was towed (indicating the vehicle registration, date, time, and location it was towed from).

This must be on letterhead, we may check with the provider to check the details.

Providing false or misleading documents is illegal. This may lead to prosecution.

I MISREAD THE SIGN / DIDN’T UNDERSTAND THE SIGN

We will not withdraw an infringement for this reason.

It is the responsibility of the driver to locate the sign that applies to them and comply with the conditions outlined on it.

I PAID FOR MY PARKING BUT STILL GOT A INFRINGEMENT / ENTERED INCORRECT DETAILS

Even a simple mistake like entering your number plate in the wrong order of letters or numbers means you have not correctly paid for parking and our Officer will be unable to detect your parking session.

If you believe you had paid for parking at the time the fine was issued, please provide as much information as possible regarding your payment so we can consider your appeal e.g., Number plate entered, parking meter number, time of payment, or EasyPark invoice.

I WAS RUNNING LATE OR DELAYED AT A MEETING / WORK

We will not withdraw infringements in these circumstances. We encourage all drivers to allow for delays when choosing a parking area ensuring to read the restrictions prior to leaving the car.

I ONLY STOPPED FOR A SHORT TIME IN A PROHIBITED AREA

We do not withdraw infringements in this circumstance.

A No Stopping Sign indicates that vehicles must not stop in the area for any reason, or any length of time, even with hazard lights on, or with occupants in the vehicle.

I FORGOT TO DISPLAY/UPDATE MY PARKING PERMIT

We will not withdraw an infringement for this reason.

If a vehicle fails to register (digitally) or display (printed) a valid Town of Victoria Park parking permit, then the driver is responsible for complying with the relevant parking restrictions applicable at the time.

Parking permits (digital and printed) must be accurately registered on the Town's vPermit system (available here) and clearly displayed (for printed permits) to gain immunity from the restrictions. The condition of use clearly states that the printed permits are to be displayed on the vehicle dashboard passenger side so that it is clearly visible from the outside of the vehicle.
