5.2024.62.1 - 72 State Street, Victoria park (Closed)


The Town has received a development application for Single House at the above-mentioned property.

 

In accordance with Local Planning Policy 37 – Community Consultation on Planning Proposals, you are invited to comment on the following:

 

  • Primary Street Setback – Council’s Local Planning Policy – Streetscape requires a minimum street setback of 3.0 metres from State Street. The application proposes a setback to State Street of 1.941 metres to a porch feature, with the majority of the dwelling sitting at the 3m setback line.
  • Boundary Setbacks – The Residential Design Codes prescribes the minimum setback distance of buildings from boundaries other than the street. The application proposes variations to the setback of the following walls:
    • Upper Floor wall to Bedroom 2 and Bedroom 3 – 1.5 metres required; 1.429 metres proposed to the common boundary with No 232 Berwick Street.
  • Boundary Walls – The Residential Design Codes prescribes that development in the R30 zone have boundary walls to a maximum of two (2) adjacent site boundaries. In lieu of this, the application proposes boundary walls to three (3) adjacent site boundaries.
  • Visual Privacy – The Residential Design Codes prescribes minimum setback distances for unscreened major openings from boundaries in order to achieve a reasonable level of privacy. The application proposes variations as follows:
    • Bedroom 2 window to the common boundary with No 232 Berwick Street. – 4.5 metres required; 4.4 metres proposed.

(Note: while the drawings provided depict a cone-of-vision setback dimension of 4.5 metres, this measurement is not exactly as per figure series 10 of the Residential Design Codes. Accordingly, consultation for the resulting variation is required).

 

Please note that the above-mentioned matters will be considered based on the merits of the case, and with regard to the relevant design principles and any comments received from nearby affected landowner(s) and occupier(s).

  •  provide adequate privacy for open space for dwellings; 
  •  allow safety clearances for easements for essential service corridors;

  • promote the creation of new streetscape environments through the use of existing rights-of-ways; and  
  • protect residential amenity from disturbance from non-residential development abutting a right-of-way and provide safety of residential development add surveillance of the right-of-way.

  • offsetting the location of ground and first floor windows so that viewing is oblique rather than direct;
  • building to the boundary where appropriate;
  • setting back the first floor from the side boundary;
  • providing higher or opaque and fixed windows; and/or
  • screen devices (including landscaping, fencing, obscure glazing, timber screens, external blinds, window hoods and shutters)
