5.2023.161.1 - 5 Custance Street, Lathlain (Closed)


The Town has received a development application for Additions to a Grouped Dwelling at the above-mentioned property. The proposed addition is for a dining room with a Lot-boundary wall that abuts No 41 Waller Street.

 In accordance with Local Planning Policy 37 – Community Consultation on Planning Proposals, you are invited to comment on the following:

  • Boundary Setbacks – The Residential Design Codes prescribes the minimum setback distance of buildings from boundaries other than the street. The application proposes variations to the setback of the following walls:
    • <Change of applicable setback to existing wall portion>

The Ground Floor to the existing dwelling wall facing the southern boundary would have a ‘deemed to comply’ setback of 1 metre setback. In lieu of this,

the setback to the existing dwelling wall to the boundary is approximately 0.8 metres. The dining room addition* increases the dwelling ‘bulk wall length’ and in turn increases the wall setback requirement from 1 metre to 1.5 metres. This increases the setback variation applicable to the existing dwelling wall (located 0.8m from the boundary).

* The lot boundary wall proposed for this addition is, in itself, deemed to comply.
