5.2023.166.1 - 43 & 43A Beatty Avenue, East Victoria Park (Closed)


The Town has received a development application for Four Grouped Dwellings at the above-mentioned property.

 In accordance with Local Planning Policy 37 – “Community Consultation on Planning Proposals”, you are invited to comment on the following:

  • Primary Street Setback – Council’s Local Planning Policy – Streetscape requires a minimum street setback of 3.0 metres from Beatty Avenue with an average setback of not less than 6.0 metres. Unit 1 proposes a setback to Beatty Avenue of 3.84 metres minimum and 5.6 metres average. Unit 2 proposes a setback to Beatty Avenue of 3.49 metres minimum and 5.56 metres average.
  • Garage Primary Street Setback - Council’s Local Planning Policy – Streetscape requires a minimum boundary wall street setback of 6.0 metres from Beatty Avenue. Unit 1 proposes a garage wall boundary street setback to Beatty Avenue of 5.28 metres minimum.
  • ROW Setback – Council’s Local Planning Policy – Streetscape requires a minimum setback of  6.0 metres from the centreline of the right-of-way. The application proposes a Common Wall setback 4.4 metre minimum setback from the centreline of the right-of-way. Unit 3 Dwelling Wall setback 5.02 metre minimum setback from the centreline of the right-of-way. Unit 4 Dwelling Wall setback 5.7 metre minimum setback from the centreline of the right-of-way.
  • Boundary Setbacks – The Residential Design Codes prescribes the minimum setback distance of buildings from boundaries other than the street. The application proposes variations to the setback of the following walls to relevant boundaries:
    • Unit 1 - Bed 3 to Garage wall – 1.5 metre setback required; 1.058 metre setback proposed to South-Eastern Boundary.
    • Unit 2 – Bed 3 to Garage wall- 1.5 metre setback required; 1.058 metre setback proposed to North-Western Boundary.
    • Unit 3- Bed 3 to Garage wall - 1.5 metre setback required; 1.088 metre setback proposed to South-Eastern Boundary.
    • Unit 4 – Bed 3 to Garage wall - 1.5 metre setback required; 1.088 metre setback proposed to North-Western Boundary.

    Please note variations to the above requirement(s) will be considered based on the merits of the case, and with regard to the relevant design principles and any comments received from nearby affected landowner(s) and occupier(s).
