5.2023.355.1 - 36 Sunbury Road, Victoria Park (Closed)


In accordance with Local Planning Policy 37 – Community Consultation on Planning Proposals, you are invited to comment on the following:

  • Primary Street Setback – Council’s Local Planning Policy – Streetscape requires a minimum street setback of 3.0 metres from Sunbury Road with an average setback of not less than 6.0 metres. The application proposes a setback to Sunbury Road of 2.3 metres minimum and 5.2 metres average.
  • Boundary Setbacks – The Residential Design Codes prescribes the minimum setback distance of buildings from boundaries other than the street. The application proposes variations to the setback of the following walls:
    • Upper floor wall (Bedroom 1 - Ensuite) of Units 2 - 4 are setback 1.2m in lieu of a minimum 1.5m from the side (north-west) boundary.

 

    • Upper floor wall (Bedroom 2 - Stairwell) of Unit 4 is setback 1.2m in lieu of a minimum 1.5m from the rear (north-east) boundary.

 

  • Visual Privacy – The Residential Design Codes prescribes minimum setback distances for unscreened major openings from boundaries in order to achieve a reasonable level of privacy. The application proposes variations as follows:

 

    • Bed 3 window of Unit 1 to side (north-west) boundary – minimum 4.5 metres required; 3.37 metres proposed.

 

    • Bed 1 window of Units 2 and 4 to side (north-west) boundary – minimum 4.5 metres, 3.7 metres proposed.

 

    • Bed 2 window of Unit 4 to rear (north-east) boundary – minimum 4.5 metres, 2.9 metres proposed

 

Please note that the above mentioned matters will be considered based on the merits of the case, and with regard to the relevant design principles and any comments received from nearby affected landowner(s) and occupier(s).

  • contribute to the desired streetscape; 
  • provide adequate privacy for open space for dwellings; 
  • allow safety clearances for easements for essential service corridors; 
  • are consistent with the rhythm and scale of development in the street; 
  • promote the creation of new streetscape environments through the use of existing rights-of-ways; and  
  • protect residential amenity from disturbance from non-residential development abutting a right-of-way and provide safety of residential development add surveillance of the right-of-way.

3.4 Lot Boundary setbacks 

Relevant design principle(s) 

P3.4.1 Lot boundary setbacks reinforce the location’s streetscape character and are consistent with the existing or desired built form local character.  

 

P3.4.2 The setback of development from lot boundaries provides a transition between sites with different land uses or intensity of development.  

 

P3.4.3 Buildings are set back from lot boundaries or adjacent buildings on the same lot to:  

  1. provide adequate solar access and natural ventilation to the building and open spaces on the site and adjoining properties; and  
  1. address the potential for overlooking and resultant loss of privacy on adjoining properties.

3.10 Visual privacy

Relevant design principle(s)

P3.10.1 Direct overlooking of major openings and active habitable spaces of adjacent dwellings and adjoining properties minimised through:

i. building siting, layout and design;

ii. design and location of major openings;

iii. landscape screening of outdoor active habitable spaces; and/or

iv. design and location of screening devices.

 

P3.10.2 Adequate visual privacy achieved through appropriate interfaces between dwellings and adjoining properties including measures such as:

i. offsetting the location of ground and first floor windows so that viewing is oblique rather than direct;

 ii. building boundary walls where appropriate;

iii. setting back the upper storeys from the lot boundary;

iv. providing higher or lower windows, or windows with obscure glazing; and/or

v. screening (including landscaping, fencing, timber screens, external blinds, window hoods and shutters).

 

P3.10.3 Visual privacy strategies maintain amenity of habitable rooms and active habitable space with regard to solar access, natural ventilation and external outlook both within the development and for adjoining properties.
